TERMS AND CONDITIONS OF 2024 WIN A BIRTHDAY OF YOUR DREAMS COMPETITION

All participants, by entering the competition, agree to be bound by the following terms and conditions:

• Promoter: Bay Street Holdings Ltd (“The Promoter”) shall conduct this competition (“the Competition”).

• Eligibility: The Competition is open to all adult persons aged over 18, residing in Malta, who are in possession of a valid identity document or residence card. The child for whom the birthday is intended must be 10 years old or under. Excluded from participation are employees of outlets within Bay Street Shopping Complex and their relatives, as well as any director, member, partner, employee, agent, or consultant of the Promoter or of any company operating within the Bay Street Shopping Complex, the marketing service providers of the Promoter, or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners, or family members in the direct or collateral line up to the first degree. Identity Card numbers provided will be used to determine age.
• Competition Period: The Competition shall open on the 14th of February 2024 and end at 22:00 on the 14th of March 2024 (the ‘Term’). Any entries received after the closing date will not be considered.
• How to Enter:

• To enter, participants must visit Bay Street during the competition period and scan the QR code displayed on our digital screens leading to a contact form. Details are to be filled in.
• Approval Process: Bay Street reserves the right to approve or reject any entry request at its discretion. Only approved entries will be eligible for the competition. The winners will also be announced on social media, and by participating in this competition, each participant shall automatically be giving his/her consent that, in the event that he/she is selected as a winner, his/her name and image be used in advertising and/or media, free of charge.
• Winner Selection: The winner will be selected by Bay Street through a random draw from all eligible entries. The draw will take place within 30 days of the closing date.
• Winner Notification & Publicity: 

• The winner will be notified via the contact details provided during entry. If the winner cannot be contacted or does not claim the prize within 15 days of notification, Bay Street reserves the right to select an alternative winner.
• The winners will also be announced on social media, and by participating in this competition, each participant shall automatically be giving his/her consent that, in the event that he/she is selected as a winner, his/her name and image be used in advertising and/or media, free of charge.

• Contact Details: Participants must enter their correct contact details in a legible manner. If a winner has given incorrect contact details, the Promoter reserves the right to select another winner in terms of these rules.
• Number of Entries: Participants may enter as many times as they wish, provided that each entry meets the criteria.

• Accompanying Adult: The winning child must be accompanied by a parent or guardian to claim and enjoy the prize.
• Party Date: The birthday celebration will take place in June, 2024. The exact date and details will be communicated to the winner in advance.
• Prizes: The prize for selected winners will be a birthday celebration package with a total value not exceeding €2000 (EUR), inclusive of all costs. The prize includes Food & Beverages and Entertainment within the Bay Street Complex, subject to Bay Street’s approval.
• Filming for Promotional Services:

• By participating in the competition, the winner and attendees consent to the birthday celebration being filmed for Bay Street’s promotional services.
• Participants understand and agree that footage may be used in various promotional materials, including but not limited to social media, website content, and advertisements.
• Liability: The Promoter shall not be liable for any other expenses incurred over and above the above prize.
• General:

• A copy of these rules can be found on the website www.baystreet.com.mt throughout the Term or can be obtained from the Bay Street Marketing Department on telephone number +356 23661585.
• Neither the Promoter, its agents, its associated companies, nor any directors, officers, or employees of such shall be liable for any loss or damage, whether direct, indirect, consequential, or otherwise arising from any cause whatsoever, which may be suffered by a participant resulting from participation in this promotion or the use of any prize.
• Participation in the Competition constitutes acceptance of the Competition rules, and participants agree to abide by the rules.
• In the event of a dispute with regard to any aspect of the Competition and/or these terms and conditions, the decision of the Promoter shall be final and binding.
• The Promoter shall not be liable for any technical failures affecting participation in the competition and assumes no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever.
• The Promoter may refuse to award the prize if entry procedures or these terms and conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
• By entering this Competition, each participant agrees to receive competition information by means of electronic mail from the Promoter, its agents, or associated companies.
